1. Acceptance of Terms

By accessing or using any services provided by Horns Sentinel Inc. ("Company," "we," "our," or "us"), including but not limited to the OSINT Platform, Sentiment AI, Horns Sentinel monitoring, Horns Stockyard, LogForge, and HornsIQ (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms").

If you are using the Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Description of Services

Horns Sentinel provides AI-powered security and intelligence tools designed for small and medium businesses (SMBs) and managed service providers (MSPs). Our Services include:

• OSINT Platform: Open-source intelligence gathering and analysis tools
• Sentiment AI: Brand monitoring and sentiment analysis
• Horns Sentinel: Security monitoring and threat detection
• Horns Stockyard: Docker container management and monitoring
• LogForge: Container log monitoring and alerting
• HornsIQ: Enterprise knowledge management bot for Microsoft Teams

3. Account Registration

To access certain features of the Services, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security of your password and account credentials
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activities that occur under your account

4. Acceptable Use Policy

You agree to use the Services only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Use the Services for any illegal activity or to violate any applicable laws
• Attempt to gain unauthorized access to any systems or networks
• Use OSINT tools to harass, stalk, or harm individuals
• Collect personal information in violation of privacy laws (GDPR, CCPA, etc.)
• Interfere with or disrupt the integrity or performance of the Services
• Attempt to reverse engineer, decompile, or disassemble any portion of the Services
• Resell or redistribute access to the Services without authorization

5. OSINT Platform Specific Terms

The OSINT Platform provides access to publicly available information. By using the OSINT Platform, you acknowledge and agree that:

• You will use gathered information only for lawful purposes
• You are responsible for verifying the accuracy of any information obtained
• We do not guarantee the accuracy, completeness, or reliability of third-party data sources
• You will comply with the terms of service of any third-party data sources accessed through our platform
• You will not use the platform for unauthorized surveillance or monitoring

6. Payment Terms

Certain Services require payment of fees. By subscribing to paid Services:

• You agree to pay all applicable fees as described on our pricing page
• Fees are billed in advance on a monthly or annual basis
• All fees are non-refundable except as required by law or as explicitly stated
• We reserve the right to change pricing with 30 days notice

7. Intellectual Property

The Services, including all content, features, and functionality, are owned by Horns Sentinel Inc. and are protected by copyright, trademark, and other intellectual property laws.

You retain ownership of any data you upload to the Services. By uploading data, you grant us a limited license to process that data solely to provide the Services to you.

8. Data Privacy

Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

9. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HORNS SENTINEL INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless Horns Sentinel Inc. and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising out of or relating to your use of the Services or violation of these Terms.

12. Termination

We may terminate or suspend your access to the Services immediately, without prior notice, for any reason, including breach of these Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions.
